‘How Is This Not Illegal?’ Fox News Pundits Outraged After Mamdani Explains People’s Constitutional Rights
Fox News contributors Jason Chaffetz and Joe Concha blasted New York Mayor Zohran Mamdani for reminding New Yorkers of their basic constitutional rights.
On Friday, the mayor released a video in which he spoke Spanish and gave tips on how to interact with Immigration and Customs Enforcement agents seeking to access private spaces such as homes or businesses.
“In a document, look for the words ‘United States District Court’ and a judge’s signature. You can ask the officers to pass the order under the door,” Mamdani explained. “If they do not have a judicial warrant, you can leave the door closed and say, ‘I do not consent to your entry.’”
He added, “Second, you have the right to remain silent. If ICE stops you on the street, ask, ‘Am I free to go?’ If the agent says yes, walk away calmly. Speak with a lawyer before signing any documents or making any decisions about your immigration status or case.”
The video sparked outrage among right-wingers, including Fox News pundits. On Friday night, Chaffetz guest-hosted Hannity, where he played snippets of the video after noting Mamdani recorded it “in Spanish” (emphasis his).
“These are your rights,” the mayor said. “First, ICE cannot legally enter private spaces without a judicial order… If they don’t have a judicial order, you can leave the door closed and say I do not consent to your entry.'”
Here is how Chaffetz and Concha reacted to the mayor of New York giving a lesson on the Fourth Amendment:
CHAFFETZ: Wow, teaching people how to avoid ICE in Spanish, Mayor.
CONCHA: No Bueno, Jason. You served on House Judiciary, right? I mean, how is this not illegal? I mean, Mamdani literally is telling people how to break the law and avoid arrest from federal law enforcement. He should be hauled in front of Congress, you know, tomorrow, immediately. And the next time he takes questions from reporters, by the way, he should be asked, “Mr. Major, do you value the lives of those you’re supposed to serve, those who are in the country legally? Or those in the country illegally?” Because I have a feeling the answer is probably door number 2 in this situation. And that’s a whole bowl of wrong in terms of his priorities. But this is pandering 101. And again, I don’t understand how this is legal. Can you explain this?
CHAFFETZ: Yeah, for him to use city resources to do it in Spanish and then try to teach people how to avoid ICE, that’s not, you know, how to avoid the federal law, that seems like a bridge too far.
Despite Concha’s claim, at no point in the video did Mamdani tell “people how to break the law.”
