‘Dangerous!’ Alan Dershowitz Goes Ballistic Over Biden FBI’s Tracking of Melania, Barron Trump

Alan Dershowitz went off on ex-President Joe Biden’s administration for conducting a “dangerous” probe into President Donald Trump’s family while he was out of office, with the famed attorney saying it looked like a flagrant abuse of the government’s power — all for the purpose of sabotaging a political opponent.

Dershowitz slammed ex-special prosecutor Jack Smith and former Attorney General Merrick Garland during a Wednesday interview with Newsmax host Greta Van Susteren. His appearance came two days after it was reported the FBI tracked Melania Trump and Barron Trump as part of Smith’s probe into Trump’s handling of national security papers; the investigation started in May 2022, when Barron Trump was 16-years-old.

Smith also covertly monitored the phone calls and emails White House Chief of Staff Susie Wiles sent in 2024, while she was co-chairing President Donald Trump’s campaign.

On Wednesday, Dershowitz said he was a “big fan” of Garland’s appointment at first, but he turned out to be a fat disappointment. The stealth tracking of Trump’s family and advisers was a big reason why, he said.

“Just signing off on something like this, without understanding the seriousness of intruding potentially on conversations — or even tracking conversations — between the person running the opponent’s political campaign for president. It’s not what we do in this country, it’s not what we’re supposed to do, and this should be looked into,” Dershowitz said. “This is unacceptable in American politics and law.”

Dershowitz explained there were two explanations for the investigations, and neither was good.

“One alternative is this is unique, this is Stalin talking to Beria — ‘Show me the man and I’ll find you the crime.’ That’s terrible. But what’s worse is: this is business as usual, that this happens all the time. That the FBI tracks people running for office,” he said.

His interview coincided with Trump being asked about the investigations while speaking to reporters at the White House. Trump said Smith and Garland were part of a “whole group of thugs” who “weaponized” the government against him and his loved ones.

“These were bad people. These are bad sick people actually, very sick people. Deranged Jack Smith, he’s a sick guy. He lied before Congress. He lied all over the place. His whole life is a lie, and so many others that were just very bad,” Trump said. “It’s a very bad group of people and they were being led by a man that didn’t lead.”

Smith testified before Congress last week on his probes into Trump.

Sen. Ted Cruz (R-TX) skewered him at one point, accusing Smith of leading “disgraceful” investigations which would go down in history as the “most egregious abuse of power in the history of the Department of Justice.” Smith seemed to shrug the grilling off, though, because he was spotted wearing his “No Kings” shirt at an anti-Trump music festival a few days later.

Dershowitz added that even if the investigations into Trump were technically “proper,” the way it was “handled is very dangerous and we ought to make sure we have things in step now that prevent it from happening [again].”
